Co., Inc. to Regions Bank (with RREF II
PEBP-GA, LLC as assignee of RREF II
PEBP Acquisitions, LLC (“RREF”), as
assignee of Regions Bank (“Regions”)),
dated May 18, 2007, recorded at Deed
Book 6B, Page 412, Jenkins County,
Georgia records; said Security Deed
being given to partially secure
indebtedness under that certain
Promissory Note (as renewed, hereinafter
the “Note”) from C. H. McTeer, Jr. to
Regions (with RREF II PEBP-GA, LLC
as assignee of RREF, as assignee of
Regions), dated May 18, 2007, and last
renewed on May 20, 2011, in the last
renewed principal amount of ONE
HUNDRED SEVENTY THOUSAND
EIGHTY NINE AND 94/100 DOLLARS
($170,089.94), with interest on the unpaid
balance from the date thereof until
maturity or until paid, together with all
other amounts payable with respect
thereto; there will be sold by the
undersigned at public outcry to the highest
bidder, for cash before the Courthouse
door in Millen, Jenkins County, Georgia,
within the legal hours of sale on the first
Tuesday in February, 2015, the property
being more fully described as follows: All
that tract or parcel of land lying and being
in the City of Millen, 1635th G. M. District
of Jenkins County, Georgia, and being
designated as Lots #3 and #4 on a plat of
same prepared by L. B. Frye, Surveyor,
Ga. Reg. #1107, dated April 12, 1975,
which plat is hereby adopted and made a
part of this description, being recorded in
the office of the Clerk of the Superior Court
of Jenkins County, Georgia, in Plat Book
7, folio 105, and being bounded as
follows: On the North by Harvey Avenue;
on the East by Lots #46 and #45 of the
Morgan Mill Subdivision; on the South by
Lot #5; and on the West by right-of-way
of U.S. Highway #25. Less and Except:
All that certain tract or parcel of land lying
and being in the 1635th G. M. District of
Jenkins County, Georgia as more
particularly described in that certain Right
of Way Deed from McTeer Tire Company,
Inc. to the Georgia Department of
Transportation dated March 16, 2006 and
recorded in Deed Book 5S, Pages 681-
687, Jenkins County Records.

The debt secured by said Note and
Security Deed has been and is hereby
declared due and payable in full because
of, among other possible events of default,
non payment of principal and interest
owed in accordance with the terms of the
Note and the Security Deed. The
indebtedness remaining in default, this
sale will be made for purposes of paying
the same and all expenses of this sale,
including attorney’s fees.

To the best knowledge and belief of the
undersigned, the subject property is in the
possession of McTeer Tire Co., Inc. and/
or Barry G. McTeer, or parties claiming
by, through or under McTeer Tire Co., Inc.
and/or Barry G. McTeer.

Said property will be sold as the property
of McTeer Tire Co., Inc. on an “as is, where
is” basis, without recourse and without
representation or warranty, express or
implied, of any nature whatsoever with
respect thereto and will be sold subject
to all unpaid taxes, assessments, and any
superior items of record, as well as any
matters as would be revealed by an
accurate survey and inspection of the
subject property.

less, and being more particularly
described as Tract 1 on that plat prepared

May 15, 1998, which plat is recorded in
the Office of the Clerk of Superior Court
of Jenkins County, Georgia, in Plat Book
12, Page 152, which plat and description
are incorporated herein and made a part
of this description by reference.

TRACT TWO: All that tract or parcel of
land situate with improvements, lying and
being in the 1635th G.M. District of Jenkins
County, Georgia, containing 0.06 of an
acre, more or less, and being more
particularly described as Tract 2 on that
plat of survey prepared by Steve
Bargeron, Ga. Registered Land Surveyor
#1871, dated May 15, 1998, revised
December 28, 2007, and recorded in Plat
Book 18, Page 29, in the office of the Clerk
of Superior Court of Jenkins County,
Georgia.

TRACT THREE: All that tract or parcel of
land situate with improvements, lying and
being in the 1635th G.M. District of Jenkins
County, Georgia, and in the City of Millen,
containing 1.27 acres, more or less, and
being more particularly described as Tract
2, on that plat of same prepared by Steve
Bargeron & Associates, Georgia
Registered Land Surveyor #1871, dated
May 15, 1998, which plat is recorded in
the Office of the Clerk of Superior Court
of Jenkins County, Georgia, in Plat Book
12, Page 152, which plat and description
are incorporation herein and made a part
of this description by reference.

Together with all buildings, structures,
improvements and fixtures attached
thereto or located thereon and used in the
operation thereof.

Said property will be sold subject to any
outstanding ad valorem taxes (including
taxes which are a lien, but not yet due and
payable), any matters which might be
disclosed by an accurate survey and
inspection of the property, any
assessments, liens, encumbrances,
zoning ordinances, restrictions,
covenants, and matters of record superior
to the Security Deed.

The debt secured by said Security Deed
has been and is hereby declared due
because of, among other possible events
of default, failure to pay the indebtedness
as and when due and in the manner
provided in the Note and Security Deed.
The debt remaining in default, this sale
will be made for the purpose of paying the
same and all expenses of this sale, as
provided in the Security Deed and by law,
including attorneys’ fees (notice of intent
to collect attorneys’ fees having been
given).

Said property will be sold as the property
of McTeer Oil Company, Inc., and to the
best knowledge and belief of the
undersigned, the party in possession of
the property is McTeer Oil Company, Inc.
or its tenants.

The proceeds of said sale will be applied
to the payment of said indebtedness and
all the expenses of said sale, including
attorneys’ fees, all as provided in said
Security Deed, and the balance, if any, will
be distributed as provided by law.

The sale is hereby conducted pursuant to
that certain Order on Motion for Relief
From Stay in favor of Lender granted on
December 8, 2014 in United States
Bankruptcy Court, Southern District of
Georgia, In re: McTeer Oil Company, Inc.,
Case No: 13-60060.

The sale will be conducted subject (1) to
confirmation that the sale is not prohibited
under the U.S. Bankruptcy Code and (2)
to final confirmation and audit of the status
of the loan with the holder of the security
deed.
