Under and by virtue of the power of sale
contained in that certain Security Deed dated
November 3, 2005, executed by Cecil
Howard McTeer III (“Borrower”) and
recorded in Deed Book 5-Q, Page 404,
Jenkins County, Georgia records, (as
amended, restated, extended or otherwise
modified, the “Security Deed”) in favor of
LSCG FUND 15, LLC, as successor-ininterest to Regions Bank (“Lender”),
pursuant to that certain Assignment of
Security Deed dated May 28, 2013 from
Lender to LSCG Fund 15, LLC recorded in
Deed Book 7E, Page 566, aforesaid records,
the undersigned, as Attorney-in-Fact for
Borrower, will sell at public outcry to the
highest and best bidder for cash, between
the legal hours of sale before the Courthouse
door of Jenkins County, Georgia, on the first
Tuesday in April, 2015 (April 7, 2015), the
following described property, to wit (the
“Property”):

TRACT ONE: All that certain lot or parcel of
land lying and being in the City of Millen,
1635th G.M. District of Jenkins County,
Georgia, being designated as Lot #8 on
a Subdivision plat for Dr. A.P. Mulkey,
prepared by Robert L. Bell, Registered Land
Surveyor, Ga. #274, dated October 22, 1964,
which plat is recorded in the Office of the Clerk
of Superior Court of Jenkins County, Georgia
in plat Book 3, Page 50, which plat and
description are incorporated herein and
made a part of this description by reference.
This lot being bounded, now or formerly, as
follows: On the North by Edith Lesher and
Buford G. Small; on the East by Walnut Street;
on the South by Mary R. Wasden; and on the
West by James G. Pike.

The above described property is identified
on Jenkins County Tax Assessor Map M08
as Parcel 009.

TRACT TWO: All that certain lot or parcel of
land lying and being in the City of Millen,
1635th G.M. District of Jenkins County,
Georgia, being designated as Lot #1 and
a Portion of Lot #2 as shown on a
subdivision plat for Dr. A.P.Mulkey, prepared
by Robert L. Bell, Registered Land Surveyor,
Ga. # 274, dated October 22, 1964, which
plat is recorded in the Office of the Clerk of
Superior Court of Jenkins County, Georgia
in Plat Book 3, Page 50, which plat and
description are incorporated herein and
made part of this description by reference.
Subject property begins at the property line
of Horace W. Parker (as shown on aforesaid
survey) and Lot #1 of said subdivision; thence
running in a southerly direction for a distance
of 100 feet to a stake; thence running westerly
for a distance of 129 feet to a stake; thence
running in a northerly direction for a distance
of 50 feet to a stake; thence running in a
westerly direction 34.4 feet to a stake; thence
running in a northerly direction 53.4 feet to a
stake; thence running in an easterly direction
163.7 feet to a stake and to the point of
beginning. This tract being bounded, now or
formerly as follows: On the North by Austin
Miettuner and Clyde Perryman; on the East
by Walnut Street; on the south by lands of
Ruby Reddick, etal and lands of Joseph law;
and on the West by lands of Wallace
Edenfield.

The above described property is indentified
on Jenkins County Tax Assessor map M08
as parcel 003.

Tract One and Tact Two were conveyed to
Heywood Kyle Gay under Executors Deed
dated July 14, 1998, recorded in Deed book
4B, Page 703, in the Office of the Clerk of
Superior Court of Jenkins County, Georgia.

The Security Deed was given to secure that
certain Promissory Note dated November
23, 2010 in the original principal amount of
SIXTY-SIX THOUSAND SIX HUNDRED
TEN AND 73/100 DOLLARS ($66,610.73)
(as amended, restated, extended or
otherwise modified, the “Note”), which was
a renewal of the Promissory Note dated
November 3, 2005 in the original principal
amount of ONE HUNDRED EIGHT

THOUSAND EIGHT HUNDRED
SEVENTY AND NO/100 DOLLARS
($108,870.00), with interest thereon as
provided in the Note until paid.

On account of defaults in the terms of the Note,
the Security Deed and other loan documents,
including Borrower’s failure to make
regularly scheduled payments when due
under the Note, Lender, the present holder
of said Security Deed and the Note, has
declared the entire unpaid balance of all
obligations secured by said Security Deed,
including principal, interest to date of sale,
and any additional fees and expenses
provided for in the loan documents to be due
and payable immediately.

The debt remaining in default and unpaid,
this sale will be for the purpose of satisfying
the principal and interest due, amounts, if any,
expended by Lender to protect its interest in
the Property, and all expenses of this sale,
including, without limitation, attorneys’ fees.

The Property will be sold subject to
outstanding ad valorem taxes and/or
assessments, and superior easements,
restrictions and rights-of-way and other
superior matters of record, if any. The
undersigned will execute a deed to the
purchaser at the sale as provided in the
aforesaid Security Deed.

To the best knowledge and belief of Lender,
the equitable title to the Property is vested in
Borrower, and the party in possession of the
Property is Borrower.

Secure Debt has been and is hereby
declared due and payable in full by reason of
default under the provisions of said Deed to
Secure Debt and the terms of the Note
secured thereby, and sale will be made for
the purpose of applying the proceeds thereof
to the payment of the indebtedness and
interest thereon, attorney’s fees and
expenses of sale, and the balance, if any, shall
be applied as provided by law (notice of intent
to collect attorney’s fees having been given).

To the best knowledge and belief of the
Lender, said property will be sold as the
property of C.H. MCTEER, III a/k/a CECIL
HOWARD MCTEER, III, and any tenants

taxes which are a lien, but not yet due and
payable), any matters which might be
disclosed by an accurate survey and
inspection of the property, any assessments,

restrictions, covenants, and easements,
against the property, if any.

The sale will be conducted subject to (1)
confirmation that the sale is not prohibited
under the U.S. Bankruptcy Code and (2) final
confirmation and audit of the status of the loan
with the holder of the security deed. All
required notices have been given at least thirty
(30) days prior to the date of sale, in writing
and by certified mail, return receipt
requested, to Borrower in default, of the
name, address, and telephone number of
the individual or entity who shall have full
authority to negotiate, amend, and modify all
terms of the Security Deed and the note
