IN RE: Dillon Trevor McMillan

The above-named Plaintiff, complaining
of the above-named Defendant, would
allege and show unto the Court as
follows:

1. The Plaintiff is a resident of the County
of York, State of South Carolina.

2. The Defendant, upon information and
belief, is a resident of the County of
Pulaski, State of Georgia or last resided
in that county and state.

3. The minor child, Dillon Trevor
McMillan has lived in the County of York,
State of South Carolina for at least 2
years.

4. The Plaintiff is the uncle of Dillon
Trevor McMillan.

5. The father, Roy McMillan, of the minor
child is now deceased.

6. The Defendant, Kimberly Michele
English and the deceased father were
previously before the court in Jenkins
County, State of Georgia in CA:
1J01DR053W wherein an Order of
Legitimation attached hereto as exhibit
1 declared that the minor child was the
legitimate son of Roy McMillan.

7. The minor child has lived in South
Carolina and continues to live in South
Carolina.

8. The Plaintiff has been substantially
involved in the minor child’s life and has
had the child in his care since Roy
McMillan died.

9. Due to the death of the father of the
minor child and the mother living in
Georgia, the best interest of the minor
child would be served by the Plaintiff
being granted custody of the child.

10. The Plaintiff requests the court to
appoint a guardian ad litem if the
Defendant contests custody.

WHEREFORE, having fully pled, Plaintiff
requests this Court to grant him custody.
