1.2 SCOPE OF WORK
The work shall consist of furnishing all products and
equipment and performing all labor necessary to
perform the following:
The work to be done shall consist of providing all
materials and performing all labor necessary to
construct and install: 6,385 LF of 18" PVC sewer
mains,28manholes,307LFofjackandbore,292SY
of removal and replacement of existing payment,

Time allotted for completion of work is two hundred
and ten (210) calendar days. All Work shall be
completed in accordance with the plans and
specifications. The Work will be awarded in one (1)
Contract.
1.3 PLANS, SPECIFICATIONS AND
CONTRACT DOCUMENTS

1.4 CONTRACTOR LICENSE & E-VERIFY
FORM
The Scope of Work as described herein is defined
as “utility contracting” in accordance with O.C.G.A
43-14-2(17) so the Contractor performing the
work must provide proof of a valid license by the
State of Georgia as a “Utility Contractor” and must
also employ a “Utility Manager” certification holder
who will have oversight of all the work. See
Instruction to Bidders for additional bidding
requirements.AnE-VerifyFormmustbecompleted
by the Contractor.
1.5 BONDS
Bids shall be accompanied by a bid bond or certified
cashier’scheckinanamountnotlessthan10%ofthe
base bid. All bonds shall be by a surety company
licensed in Georgia with an “A” minimum rating of
performanceandafinancialstrengthofatleastfive(5)
times the contract price as listed in the most current
publication of “Best’s Key Rating Guide Property
Liability”. PerformanceandPaymentBonds,eachin
anamountequalto100%ofthecontractpriceshallbe
requiredofthesuccessfulbidderifcontractisawarded.
Each Bond shall be accompanied by a “Power of
Attorney” authorizing the attorney-in-fact to bind the
surety and certified to include the date of the bond.
1.6 FUNDING SOURCES
The US Department of Commerce Economic
Development Administration is providing partial
funding for this Investment No. 04-01-06557. All
Bidders must comply with 41 CFR 60-4, in regard to
affirmativeaction,toinsureequalopportunitytofemales
andminoritiesandwillapplythetimetablesandgoals
set forth in 41 CFR 60-4, as applicable to the area of
theproject.
1.7 RESERVATION OF RIGHTS
Owner reserves the right to reject any or all Bids and
towaiveinformalities,includingwithoutlimitation,the
rights to reject any or all nonconforming, nonresponsive, unbalanced or conditional Bids and to
reject the Bid of any Bidder if Owner believes that it
wouldnotbeinthebestinterestoftheProjecttomake
an award to that Bidder, whether because the Bid is
notresponsiveortheBidderisunqualifiedorofdoubtful
financial ability or fails to meet any other pertinent
standard or criteria established by the Owner.

NOTICE OF SALE UNDER POWER
IN DEED TO SECURE DEBT
THIS LAW FIRM IS ACTING AS A DEBT
COLLECTOR ATTEMPTING TO COLLECT A
DEBT. ANY INFORMATION OBTAINED WILL
BE USED FOR THAT PURPOSE
On the 9th day of April 1998, FRANK ROPER,
JR. and RUBY DELL ROPER, (“Roper”)
executed a Note and on the 29th day ofApril 1998,
executed a corrected Deed to Secure Debt for
$172,116.60 payable to Jim Walter Homes, Inc.,
conveying property described in Exhibit “A”, and
recorded in the Office of the Clerk of Superior Court
of Jenkins County, Georgia, in Deed Book 4A,
Pages 785-787. Said Note and corrected Deed to
Secure Debt were subsequently assigned to U. S.
Bank, N.A. as Trustee on behalf of Mid-State Trust
VII, (“US Bank”), by assignment dated October 16,
2012, with an effective date of January 1, 2012,
and recorded in aforesaid Clerk’s Office in Deed
Book 7-B, pages 270-286.
Default has been made in the installment
payments due for September 2012, and
subsequent thereto. US Bank declared the entire
unpaid indebtedness due and payable in
accordance with the terms of said Note, and the
same has not been paid.
The corrected Deed to Secure Debt provides that
when the Note secured thereby becomes due and
is not paid, that said property may be sold before
the Courthouse door of Jenkins County, Georgia,
upon US Bank first giving notice of the place and
terms of such sale (1) time a week for (4) weeks in
the newspaper in which the sheriff’s
advertisements are published, and where said
property is located.
NOW THEREFORE, pursuant to the powers
contained therein, the property will be sold before
the Courthouse door in Jenkins County, Georgia,
at public outcry on the first Tuesday in June 2013,
between the legal hours of sale.
US Bank will convey title to the purchaser as
attorney-in-fact for Roper. The money derived from
the sale will be applied: first to the expenses of said
sale; secondly, to the amount due on said Note;
and the balance, if any, shall be paid to Roper.
TERMS: Cash,subjecttoStateandCountyadvaloremtaxes
or assessment and any federal tax liens of record.
Purchaser is to pay for all legal papers and revenue
stamps.
